Real Estate Agents

When selling a property, the usual course of action is to engage a Real Estate Agent. It should be noted that the commission of a Real Estate Agent is negotiable, so use this to your advantage.

Section 32 Statement

A complete and accurate Section 32 Statement is crucial. If there is a mistake in the s32 then the purchaser has the option to rescind the contract of sale. It is for this reason that an experienced Conveyancer should be employed to compile the s32 statement.

Maintenance

The seller is obligated to provide the property to the purchaser at the date of settlement in substantially the same condition that it was in when the contract of sale was entered. It is the seller’s responsibility to maintain the property over this period.

Be sure that your home insurance runs until the date of settlement.

Owner Builders & Building Warranty Insurance

Contracts of sale signed by home-owner builders must contain special conditions protecting the purchaser; otherwise the purchaser can avoid the contract any time before settlement.

If the building is under 7 years old, or has had renovations done in the past 7 years with a value of $12,000 or more, then the seller is obliged to supply building warranty insurance, an occupancy certificate, a copy of the building permit and an independent builder's inspection report.

Notices

Any notices that are issued after the contract date are the responsibility of the purchaser.

Special Conditions

The special conditions in the sale contract can be used to customise the contract allowing you to retain certain fittings, for example, your dishwasher or washing machine.
